When a power of attorney needs a notary

A power of attorney lets someone act for you. A notary is what gets it accepted overseas.

You need a notary when:

Your power of attorney will be used in another country.
A foreign bank, court, or authority has asked for a notarised or apostilled copy.
You are signing for a property sale, purchase, or inheritance abroad.
You are giving someone authority to act for your business overseas.

You do not need a notary when:

Your power of attorney is only for use in the UK.
You are making a lasting power of attorney for a UK bank or care decision.

For UK-only matters, a general power of attorney is a deed, so an independent adult witnesses your signature.

A lasting power of attorney has stricter rules, and you must register it with the Office of the Public Guardian before anyone can use it.

4 steps take you from document to delivery.

Step 1: Document review and quote

Send us your power of attorney and tell us which country you will use it in. We confirm the required items and send you a fixed quote.

Step 2: Notarisation

You can attend your appointment in person, by mobile visit, or online by video. You have to bring your ID. The FCDO-registered notary checks who you are, confirms you understand the document, watches you sign, and applies their stamp and certificate. The appointment takes 15 to 30 minutes.

Step 3: FCDO apostille

We submit your notarised power of attorney to the Foreign, Commonwealth and Development Office (FCDO). Our next-day apostille service returns it within 1 working day. The standard apostille service takes around 3 to 4 working days.

Step 4: Embassy attestation, if you need it

Countries outside the Hague Convention need one more step. For the UAE, Qatar, Egypt, Kuwait, and similar destinations, we handle the embassy attestation for you. The UAE usually takes 8 to 10 working days, and Qatar takes 10 to 14 days.

Frequently asked questions (FAQs)

Below are a few common questions about getting a power of attorney notarised.

Who writes the Power of Attorney?

Whoever will act on it abroad should supply the wording: your lawyer in the destination country, the bank, the court, or the company registry. LAS handles notarisation and legalisation, not drafting, and the notary attests your signature rather than composing the document. You decide what powers to grant, but the receiving party decides what it will accept, and civil law countries typically want each power set out precisely, often in a bilingual or prescribed format.

England and Wales does have a statutory short form of general power of attorney, but it is built for domestic use and foreign authorities rarely accept it. Ask your contact abroad to send you the wording they need, then bring the signed document to us and we will take it through notarisation and apostille.

Can I sign the Power of Attorney digitally?

Sometimes. Many powers of attorney are signed in ink because the receiving country wants an original signature on paper. Remote notarisation by video is available in many cases: you show your ID and sign on camera, then post the original for the notary to stamp and certify.

Whether a digital or remote signature is accepted depends on the country where you will use the document, so check with them first.

How long does power of attorney notarisation take?

The appointment itself takes 15 to 30 minutes. Most of that is the notary checking your ID, going through the document with you, and watching you sign.

You leave with it notarised the same day, unless you signed by video, in which case you post the original to the notary to stamp and certify.

Can you notarise a power of attorney for use in Spain, France, and other EU countries?

Yes. Every EU country is party to the Hague Apostille Convention, so your notarised power of attorney needs an apostille rather than embassy legalisation. Most authorities will then ask for a sworn translation, which in Spain means a traductor jurado accredited by the Ministry of Foreign Affairs, not simply a competent bilingual translator.

There is a way to keep that cost down. When you ask your lawyer abroad for the wording, ask whether they can supply it bilingually. If the power of attorney is already in English and Spanish, only the notarial certificate and the apostille need translating, which is a small fraction of the text and a small fraction of the fee. The translation still has to be done after the apostille is attached, so that the apostille is covered too.

What identification do I need for a notary appointment?

You need one valid photo ID and one proof of address. A passport is best for photo ID. A recent utility bill or bank statement works for proof of address, and a valid UK or overseas address is fine as long as it is current.

For a company power of attorney, the notary will also check your company details and your authority to sign.

Can I arrange an urgent notary appointment?

Yes. We can often arrange a same-day or next-day appointment, including mobile visits and online video. If you need the apostille quickly too, our express service can add it the next working day. The cut-off for the express service is 9:30 am.
